WE URGE YOU TO READ CAREFULLY THE FOLLOWING TERMS OF TRADING WHICH FORMS YOUR CONTRACT WITH McBrideGOLF .
It is our main interest to ensure that you have the best vacation possible. To this end you can be confident that we have done everything to guarantee that all the arrangements made on your behalf operate as smoothly as possible. When we receive your first payment your reservation will be accepted and acknowledged by McBrideGOLF, who will then return a receipt and confirmation of reservation. A contract then comes into force, and both sides have a responsibility towards the other. Your responsibility is to pay McBrideGOLF the tour price in accordance with set out conditions; our responsibility is to provide you with the basis of the agreement between you and McBrideGOLF.
YOUR PROMISE TO US
No person or organization should agree to reserve a tour unless they are prepared to accept the obligations involved. Our communication may be with one person who has the delegated authority to act on behalf of the other group members. However, the content of our terms and conditions apply to each individual person/passenger. By entering into this contract, every person has a responsibility to pay any deposit and the full cost when due. If you fail to make due payments we are entitled to terminate the contract. We may levy interest on all monies due at a rate of 2% for any calendar month, or part of a month, after the due date for payment.
CONTRACT
No contract exists until McBrideGOLF has received the first payment (together with the names of your party) and has issued a confirmation of reservation. This contract is made on the terms of these trading conditions, which are governed by Australian Law and both parties agree to conform to the jurisdiction of the Australian Courts.
CONFIRMATION OF BOOKING:
In order to confirm a booking a non-refundable deposit of 40% of the quoted cost per person, is required. It may be paid by check, wire transfer (details will be provided on request) or credit card - MasterCard or VISA, subject to a 1.75% bank charge. Bookings are only accepted subject to the availability of required tour services such as accommodations and golf starting times. Payment of balances and cancellation penalty schedules for our programs is as outlined below.

McBride Golf recommends that you have luggage, accident and trip cancellation insurance. McBride Golf is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness. It is important for your own self-interest and protection that you make certain you have adequate coverage. Check with your insurance company or travel agent.
TOUR PRICES
The price of your vacation may be subject to currency surcharges, if quoted in $USD. Should the USD $ to GBP £ vary by more than 10% between booking and payment of final balances, McBrideGOLF reserves the right to apply a surcharge of 50% of this difference. McBrideGOLF will absorb the remaining amount. We may also apply the following surcharge - transport costs, or change in government legislation concerning Tour Operators (such as increase in, or imposition of VAT or other government taxes). In this case, we will absorb an amount equivalent to 1% of the vacation price, which excludes amendment charges. Only amounts in excess of this 1% will be surcharged. If this means paying more than 10% on the holiday price, you will be entitled to cancel your holiday with a refund of money paid except for any premium paid to us for amendment charges and for tee times at St Andrews and Muirfield. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed on the invoice. This guarantee is subject to all payments of the first deposits and tour balances being made on or before the due date. Because we must absorb some increases in cost, we cannot give any refunds in the event of favourable currency movements. If a withdrawal, cancellation or cancellations reduce the number in the party below that which is required for a particular tour price then the tour price will be recalculated on the basis of the actual party size.
CAR RENTAL:
On independent tours with a rental car, all drivers must be over 25 years of age, and under 65. This can be varied under certain circumstances. Specific terms and conditions relating to your car rental can be provided on request, depending on your destination.
AIR TRAVEL:
Airline tickets for travel on scheduled airlines, if they should be issued for you by McBride Golf, are a separate item out with the travel package, and may carry change and cancellation penalties as specified by the carrier. If McBride Golf are including internal air transfers as part of your package it is your responsibility to provide McBride Golf with your personal details as included on your passport. Failure to do this may result in your being denied boarding of the aircraft.
DOCUMENTATION:
For US citizens, a current passport is required for overseas travel. Please check for visa requirements. Citizens of other countries should check with the appropriate Embassy.
CHANGES:
An administrative fee of $100.00 USD per change per person will be charged for changes requested by client or travel agent after deposit has been received and confirmation issued. In most cases, changes cannot be made less than 60 days before travel, subject to specific exceptions.
McBrideGOLF reserves the right to make minor alterations to the reservation. The sequences of the tours are given as a guide only and it may, on occasion, be necessary to make changes or substitute the order of golf courses and accommodation.
NAME CHANGES:
In the event you wish to change the name of one of the golfers previously confirmed on a trip, the following per person charges shall apply; more than 60 days before departure - a charge of £ 100 plus any applicable non refundable deposits paid to golf clubs which prohibit transfer of deposits, 60 - 21 days before departure a charge of $500USD plus any applicable non refundable payments made to golf clubs which prohibit transfer of same; less than 21 days before departure a charge of $1000USD plus any applicable non refundable payments made to golf clubs which prohibit transfer of same.
GOLF HANDICAPS:
A number of golf clubs require visitors to show handicap cards. We strongly recommend you travel with a handicap card, and we accept no responsibility if you do not and are subsequently denied golf. Certain clubs also place maximum handicap restrictions on visitors. If your handicap is greater than 24 (men) or 36 (ladies) please notify us in order we can discuss which clubs may have relevant restrictions. Also, please note that McBride Golf can accept no responsibility for the playing conditions of any golf courses, including changes caused by course maintenance or weather conditions.
CANCELLATIONS:
Notification of cancellation by a client must be forwarded in writing to McBride Golf. Cancellation charges vary dependent on the travel package purchased. No refund will be made for unused portions of a travel package.
OUR RESPONSIBILITY
When you contract with us to make a reservation, we act as principal to you. McBrideGOLF accepts all responsibility for ensuring that the tour reserved is of a reasonable standard and is arranged with due care and diligence. We also accept responsibility for the acts or omissions of this firm's employees. McBrideGOLF will also accept responsibility should the services the firm has contracted to provide prove deficient. Our liability will in all cases be limited to a maximum of the total cost of that element omitted. In respect of carriage by air, sea and rail and the provision of accommodation our liability under this clause will be limited to international convention.
McBride Golf is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour.
McBride Golf reserves the right to cancel a tour if circumstances so require. In the event of such, McBride Golf will make a full refund to travellers of all payments received in respect of the tour. Such a refund of payments will be the full extent of McBride Golf's obligation and liability to travellers. This Agreement shall be governed by the substantive laws of Western Australia.
IF YOU HAVE A COMPLAINT
If a problem arises you should report it as quickly as possible to our Representative or Agent and the Supplier so that efforts can be made to rectify it to your satisfaction. Our Representative or Emergency Contact can deal with most problems on the spot, so please do not wait until you get home before reporting a problem. If we are unable to resolve matters you must write to our Head Office within 30 Days of return, explaining the problem fully.
Terms for Sub-contractors
- Sub-contractors, including coach operators, may not accept any new obligations or follow a course of action and conduct in a way that is inconsistent with the duties owed to McBride Golf.
- Sub-contractors, including coach operators, may represent the interests of more than one tour operator or Principal, conflicting or potentially conflicting, only on the basis of full and timely disclosure to McBride Golf in order to prevent a situation where the Agent's loyalty to any one of the Principals is compromised.
- Sub-contractors, incluiding coach operators, may not make a private profit or unjustly enrich themselves from their relationship with McBride extraneous to the consideration agreed for the relevant service.
- Sub-contractors, including coach operators, should not promote their own services, solicit or undermine the reputation of McBride Golf to third parties.
- Sub-contractors, including coach-operators, must advise of any known relevant circumstances which McBride Golf would consider to be commercially deleterious and the knowledge of which would have caused McBride Golf to act differently.
